THIRD PARTY PAYMENT GATEWAYS PROVIDERS
All Payments made by you make through “Studyon Platform” and/or the “App” will be processed by Third Party Payment Gateway Companies. We under no circumstances hold responsibility for errors, misuse or any other activity made by the Payment Gateway Providers. All disputes arising because of the above activities will be dealt by the Payment Gateway Providers. We avail services of the most trusted and widely used Payment Gateways on “Studyon Platform” and/or the “App” to avoid any frauds or scams. Third party payment gateway’s may also have access to your order details on “Studyon Platform” and/or the “App”. In case of legal proceedings arise in relation to your uploaded content, comments, etc. on “Studyon Platform” and/or the “App”, we will share your personal information to conduct and resolve the disputes, comply with a subpoena, or legal processes. We reserve the right to report any activity which violates the laws to the law enforcement agencies. Although the internet technologies are not 100% secure, therefore we encourage you to be careful while using the same. This “Studyon Platform” and/or the “App” holds ‘no refund’ policy as the purchase you do is digital, and is made available to you instantly. Please note that the digital content purchased cannot be downloaded, copied, or stored on your personal hard disk drive of laptop/computer or any other external device. UPLOADING OF CONTENT, INTERACTION OF SOCIAL MEDIA PLATFORMS AND PUBLIC FORMS
The content and social media feed you upload or post, the comments you give, and the feedback you provide at the “Studyon Platform” and/or the “App” is done at your own risk. You may edit or remove the information you provide us on “Studyon Platform” and/or the “App”. You may also contact us to remove any content you published on various public forums accessible and controlled by us. You understand and acknowledge that if prior to the removal of content from the “Studyon Platform” and/or the “App”, if any user(s) had stored the information presented by you on their cache or archived pages, then the we are not responsible for any violations or disputes arising because of the information you share.
PROFILE CREATION AND USAGE
In order to utilise the features of “Studyon Platform” and/or the “App”, you are required to create your profile that will be visible to other users on the internet and on “Studyon Platform” and/or the “App” or associated Website(s) and Mobile App(s). Your profile will allow you to upload your products, purchase products, share your personal information, etc. Your profile will helps other users identify you and the type of products uploaded by you. Your profile may be indexed and displayed by various internet search providers when someone searches for your name or products uploaded by you or similar products uploaded by other users. The “Studyon Platform” and/or the “App” is not responsible for any type of indexing done by the internet search Websites or any third party Websites. If you do not want your information to be indexed or displayed in the search results, then you must close your account which can be done by emailing us at mvijiabraham@gmail.com.
SHARING OF PERSONAL INFORMATION
We will share your Personal Identifiable Information with third parties whose services we avail. MOBILE USE
When you access your account on our mobile app installed on your iOS, and Android, then we might collect your device ID, mobile carrier and your GPS location to collect, store and use this information to provide you offers and product related information customised to your interests. A Device ID (Identifier) is a number allocated to a device. Our “Studyon Platform” and/or the “App”may access your device using your device ID. You may turn-off your location detection feature for our mobile app in your mobile’s settings panel. Studyon FEATURES DESCRIPTION
“Studyon Platform” and/or the “App” allows users to upload, purchase, sale, sharing and distribution typed or handwritten digital content via the Website and/or Mobile App. The content stored on the “Studyon Platform” and/or the “App” cannot be downloaded or copied to the local disk of your computer/laptop, mobile or any external device. In order to access and view the content purchased on the “Studyon Platform” and/or the “App”, the registered user is required to login and download or synchronize their purchase history on the mobile application. User can synchronize their purchased content using Wifi or mobile internet connectivity. The purchased content can be viewed in offline (no Wifi or Mobile Internet Plan) mode. We advise users to use “Studyon Platform” and/or the “App” for content read only. If any user is found violating any of the “Terms of Use” then Studyon reserves the right to terminate their account. Even after deletion of the account, Studyon keeps the information of the user under the ‘Blocked Accounts’ category, thereby avoiding any attempt to re-register.

Obtain, or design to obtain website access of individual or organization for performing unauthorized commercial or unlawful activities, or pay/accept payments from any individual or organization to perform activities on the mobile application.
Involved in creation, promotion, and distribution of junk email, mass emailing, email stalking, spamming, etc. using the content viewed via “Studyon Platform” and/or the “App”.
Exploits group or individual in a sexual, personal, or violent manner.
Constitutes, promotes, distributes and manages content that promotes illegal activities like making or buying of drugs, illegal weapons, violating a group, groups or individual privacy, pornography, fraud, gambling, harassment, defamation, sending of viruses or harmful files, or creating, copying, modifying, distributing, downloading, scrapping, transmitting or sharing the content, present on the mobile application fully or partially.
Creates, promotes, or displays information that creates privacy or security risk and breach to any group or individual.
Tries to change the policies of the “Studyon Platform” and/or the “App”.
Creates, destroys, modifies, or distributes instructions to harm the network, database, security technology software, hardware, affecting the “Studyon Platform” and/or the “App” functioning.
Falsify or delete author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of content contained in a file uploaded.
Violate any applicable laws or regulations for the time being in force in or outside India.
Creating, performing or distributing instructions to implement manufactured installed copy-protect devices, or activity that involves of use of viruses, bots, worms, computer code, pirated programs, files, software, hardware, etc. that hampers, destroys or disrupts the functionality of any computer hardware or software, or permit unauthorized use or access to a computer or a computer network to interfere, damage, modify, or disrupt Studyon’s design, icons, and other parts of Studyon via CSS/HTML 5.
REPORTING INFRINGEMENT ON Studyon
Studyon respects the intellectual property rights and any other similar rights of others and takes extreme steps in protecting the copyrights and other intellectual property rights. If you find that your content has been uploaded by someone else, please email us the Infringement Notice (notice format given in the Copyright Policy) to mvijiabraham@gmail.com. With reference to this aspect all the disputes/conflict that are related directly or indirectly with the Terms of Use, that belong to “Studyon Platform” and/or the “App” are to be submitted only in the adequate courts in Delhi. The adequate courts are personalized with the related authority of its kind. In case if your disputes are found Counterfeit then you will be highly responsible to undergo the penalty of the jurisdiction.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless Studyon and any associated website(s) from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Studyon that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms.
LIMITATION OF LIABILITY
In no event shall Studyon and any associated website(s), including but not limited to its subsidiaries, directors, officers, employees, representatives and agents, be liable for any indirect, special, incidental or consequential damages whatsoever, whether arising in contract or tort (including negligence), or related to the use or inability to use the “Studyon Platform” and/or the “App”, even if Studyon has been advised of the possibility of such damages. You agree that the entire liability of Studyon (including its subsidiaries, directors, officers, employees, representatives and agents) under these Terms of Use or otherwise in connection with the “Studyon Platform” and/or the “App” shall not exceed the amount of INR 5000. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you and you may have additional rights. In that case, Studyon’s liability will be limited to the fullest extent permitted by applicable law. The exclusions and limitations of liability in these terms of use will apply notwithstanding any failure of essential purpose of any limited remedy. This section shall survive any expiration or termination of your relationship with Studyon.

Studyon is not responsible for the User Content accessed and viewed on the “Studyon Platform” and/or the “App”. Such Content is not necessarily investigated or monitored for accuracy or completeness by Studyon and any associated website(s). Studyon and any associated website(s) are not responsible for any damage, injury or loss including, without limitation, personal injury or death to the users, resulting from use of the website or associates websites. This section shall survive any expiration or termination of your relationship with Studyon.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, “Studyon Platform” and/or the “App” SPECIFICALLY DISCLAIMS ANY AND ALL EXPRESS, STATUTORY OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, OF MERCHANTABILITY AND OF NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, “Studyon Platform” and/or the “App” SPECIFICALLY DOES NOT WARRANT THAT OUR FEATURES ARE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVER, NETWORK OR OTHER SOFTWARE AND EQUIPMENT THAT MAKES THE FEATURES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. “Studyon Platform” and/or the “App” DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE CONTENT OF ITS PRODUCTS, OR REGARDING THE RESULTS OF THE USE OF “Studyon Platform” and/or the “App” IN TERMS OF THE CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE, UNLESS SPECIFICALLY SET OUT ON THE “Studyon Platform” and/or the “App”.
MODIFICATION AND TERMINATION OF TERMS OF USE
The norms under the Terms of Use of “Studyon Platform” and/or the “App” will be modified and updated as per our desired time and decision. Studyon reserves the right, at our discretion, to change, modify, add, or remove portions of these Terms or any additional terms, at any time. These changes will not be pre-informed to you. If Studyon comes across any member of the “Studyon Platform” and/or the “App” who has counterfeited or acted against the Terms of Use, Studyon will reserve the right to terminate the user account and claim penalty through the legal proceedings. It’s important that you review the Terms whenever we modify them because Your continued use of the “Studyon Platform” and/or the “App” after the posting of changes constitutes Your binding acceptance of such changes. If you don’t agree to be bound by the modified Terms, then you may not use the “Studyon Platform” and/or the “App” anymore. Because “Studyon Platform” and/or the “App” is evolving over time we may change or discontinue all or any part of the “Studyon Platform” and/or the “App”, at any time and without notice, at our sole discretion.
